Welcome to Short Dot (SD). We are a domain name registry. These Terms of Use and Privacy Policy are intended to explain our obligations as a service provider and your obligations as a customer. Please read them carefully. If you do not agree to the terms please do not use our services or websites (See Nic.icu) You are further stating that you are 18 years of age or older and accept the binding arbitration and limitations of damages clauses below along with all other terms and conditions listed herein. If you do not agree with any of these terms please do not access the site.

By using our services and/or website you acknowledge that you have read and understood these terms and have the authority to act on behalf of yourself, your company, or any person you represent who is using the service provided. You are deemed to have agreed to these terms on behalf of any entity for whom uses the service.

The following clauses exclude or limit our legal liability for the Site and services, to the fullest extent permitted by applicable law.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT, AND UNDER NO THEORY OF LAW OR EQUITY, WILL SD (INCLUDING, WITHOUT LIMITATION, SD’S OWNERS, EXECUTIVES, DIRECTORS, OFFICERS, ATTORNEYS, MANAGERS, EMPLOYEES, CONSULTANTS, CONTRACTORS, AGENTS, PARENT COMPANIES, SUBSIDIARIES, CO-SUBSIDIARIES WITH THE SAME PARENT COMPANY AS SD, AFFILIATES, THIRD-PARTY PROVIDERS, MERCHANTS, LICENSORS, OR THE LIKE) OR ANYONE ELSE INVOLVED IN CREATING, PRODUCING, OR DISTRIBUTING SD’S SERVICES, BE LIABLE FOR THE LOSS OF A DOMAIN NAME, OR ANY BUSINESS OR PERSONAL LOSS, REVENUES DECREASE, EXPENSE INCREASE, COSTS OF SUBSTITUTE PRODUCTS AND/OR SD SERVICES, OR ANY OTHER LOSS OR DAMAGE WHATSOEVER, OR FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE, OR INDIRECT DAMAGES OF ANY KIND ARISING OUT OF ANY USE OF, OR ANY INABILITY TO USE, ANY SD SERVICES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SD’S TOTAL CUMULATIVE LIABILITY, IF ANY, TO CUSTOMER, OR ANY THIRD PARTY, FOR ANY AND ALL DAMAGES, RELATED TO THIS AGREEMENT OR SD’S SERVICES, INCLUDING, WITHOUT LIMITATION, THOSE FROM ANY NEGLIGENCE, GROSS NEGLIGENCE OR ANY ACT OR OMISSION BY SD OR OUR REPRESENTATIVES, OR UNDER ANY OTHER THEORY OF LAW OR EQUITY, WILL BE LIMITED TO, AND WILL NOT EXCEED, THE ACTUAL MONETARY AMOUNT PAID BY THE CUSTOMER FOR THE SERVICES WHICH GAVE RISE TO SUCH DAMAGES, LOSSES, AND CAUSES OF ACTIONS DURING THE 3-MONTH PERIOD PRIOR TO THE DATE THE DAMAGE OR LOSS OCCURRED OR THE CAUSE OF ACTION AROSE.

No Warranties

SD gives no warranty about the Services. Without limiting the foregoing, SD does not warrant that the Services will meet Your requirements or that it will be suitable for any particular purpose. To avoid doubt, all implied conditions or warranties are excluded in so far as is permitted by law, including (without limitation) warranties of merchantability, fitness for purpose, title and non-infringement. The use of the Site is at your sole risk. We shall not be liable for any loss or damage whatsoever and howsoever arising as a result of your use of or reliance on the information contained on the Site to the maximum extent permitted by law.

We do not represent or warrant any uptime, that access will be uninterrupted, that there will be no failures, omissions, errors, or loss of transmitted information, that no viruses will be transmitted or that no damage will occur to your computer system. You are solely responsible to protect yourself and your equipment. We take no responsibility for and do not endorse any third party software whether or not used in connection with the site or service.

Indemnification

You agree to protect, hold harmless, and indemnify SD, its affiliates, any third party entity related to SD and its affiliates (including, without limitation, third party vendors), and their executives, directors, officers, attorneys, managers, employees, consultants, contractors, agents, parent companies, subsidiaries, and co-subsidiaries with the same parent company as SD, from and against any and all liabilities, losses, costs, judgments, damages, claims, or causes of actions, including, without limitation, any and all legal fees and expenses, arising out of or resulting in any way from your use of our services.

Errors in the description, photography, or typographical errors as well as any modifications to the site in general or to these terms and conditions are subject to correction or change at the sole discretion of SD. No license to use or reproduce any of these trademarks or other trademarks on this website is given or implied. All other brands and product names are the trademarks of their respective owners. You may display and, subject to any expressly stated restrictions or limitations relating to specific material, download or print portions of the material from the different areas of the website solely for your own non-commercial use. You further agree not to change or delete any proprietary notice from materials downloaded or printed from the website. All trademarks, service marks, and trade names of SD used in the website (including but not limited to the Short Dot name, the ShortDot circle in a circle design, are trademarks or registered trademarks of SD. They may not be used without SD’s prior written permission. Any other intellectual property in the website, including but not limited to patents, issued or pending, are the sole property of SD and/or its licensors.

Ownership Account

The individual or organization whose name is listed in our database as the owner will be considered the legal owner of and be responsible for any action associated with a customer account with SD. You will fully cooperate with and abide by any and all of our security measures and procedures as required by SD staff. Either you or we may terminate your account with SD at any time for any reason. If you fail to terminate you will be responsible for all fees even if you thought you terminated your account. You specifically agree not to: Distribute content intended to harass, abuse, threaten, impersonate any other individual or entity, and disseminate obscene, defamatory, indecent, harmful, libelous, and or unlawful material/information; Use the site or services for commercial purposes; Transmit or upload programs or material that contain harmful programs; Transmit or upload any material that contains software or other material that is protected by Int. Prop. laws and/or would infringe upon rights of privacy or publicity of a third party unless the user owns or controls the rights thereto or has received a license, permission and/or consent thereto. Try to gain unauthorized access to the services; other users’ accounts, or computers connected to the Services through password mining or other means; Interfere with another user’s use and enjoyment of the site or services or any other individual’s user and enjoyment of similar services. Further, you may not: use a false identity; sending us false or illegal content or that violates or causes damage to the rights of a third party; junk mail; taking any action that may disrupt the operation of Theporndude.com.SD reserves the right to deactivate or cancel any customer account with no obligation to return any funds paid if any of the above terms are violated. SD will be the sole arbiter as to what constitutes a violation of your obligations under this Agreement. SD reserves the right to remove any account without prior notice and to refuse service to anyone at any time.

Customer responsibility

Customers are required to use SD’s services, network, and servers responsibly. This includes respecting other SD customers and users of the Internet. We reserve the right to suspend and/or cancel service with any customer who uses our network in such a way that adversely affects other SD customers or users of the Internet. While we may monitor our service electronically to determine that our facilities are operating satisfactorily, as a general practice, we do not monitor our customers’ communications or activities to determine whether they are following this Agreement. However, when we become aware of any violation of this Agreement or other user agreements, we reserve the right to take any action to stop or correct such violation, including, but not limited to, denying access to our services and equipment or to the Internet. In addition, SD may act against a customer because of the activities of such customer.

Privacy Statement

SD values its customers and all technically feasible steps are taken to protect their privacy. In general, when you visit our website and access information, you remain anonymous. Collected information is used to respond to online queries, gather account information, supply requested information on SD’s products and services, ship ordered products, establish approved links, and for internal market analysis. We do not sell or rent personal information to third parties.

Our web servers collect the domain names of visitors to our sites. This information is aggregated to determine the number of visits, average time spent on our website, the pages viewed by visitors, and other similar information. Children under the age of 18 should submit personally identifiable information to SD only with the explicit permission of their parent or legal guardian. If your child has submitted personal information and you would like to request that such information be removed, you may do so by contacting the Sales and Marketing Manager at SD via the methods listed above in ~Contact and reasonable efforts will be used to comply with your request. 

Governing Law and Severability

ANY CLAIM RELATED TO THE INFORMATION ON THIS WEBSITE WILL BE GOVERNED BY THE LAWS OF LUXEMBOURG WITHOUT REGARD TO CONFLICTS OF LAW RULES. IN THE EVENT OF ANY DISPUTE REGARDING THIS WEBSITE, THE PARTIES IRREVOCABLY CONSENT TO EXCLUSIVE PERSONAL JURISDICTION AND VENUE IN THE COURTS IN LUXEMBOURG.

ANY DISPUTES SHALL BE SUBMITTED TO BINDING ARBITRATION.  YOU UNDERSTAND THAT THIS CLAUSE MEANS YOU ARE GIVING UP YOUR RIGHT TO A TRIAL BY JURY.  YOU SHOULD CONSULT AN ATTORNEY BEFORE ACCEPTING THIS AND ALL TERMS IN THIS BINDING AGREEMENT.

If any provision or portion of this Agreement or other SD agreement is found by a court of competent jurisdiction to be unenforceable for any reason, the remainder of this Agreement or the agreement will continue in full force and effect.

Severability:

If any part or provision of these Terms is invalid, unenforceable, or in conflict with the law, that part or provision is replaced with a provision which, as far as possible, accomplishes the original purpose of that part or provision. The remainder of this Agreement will be binding on the parties.

Rights of Third Parties:

A person who is not a party to these Terms has no right to benefit under or to enforce any term of these Terms.

Unenforceability:

If any provision of the Agreement is held or made invalid or unenforceable for any reason, such invalidity will not affect the remainder of the Agreement, and the invalid or unenforceable provision will be replaced by a valid provision that has a similar economic effect. 

Force Majeure:

Except for your payment obligations, neither we nor you will have any liability under the Agreement by reason of any failure or delay in the performance of our or your obligations on account of strikes, shortages, riots, acts of terrorism, insurrection, fires, flood, storm, explosions, earthquakes, Internet and/or electrical outages, computer viruses, acts of God, war, governmental action, or any cause that is beyond our or your reasonable control.

Independent Contractors:

You and we are independent contractors and nothing in the Agreement will be construed to create, evidence, or imply any agency, employment, partnership, or joint venture between you and us. Except as otherwise set forth in the Agreement, neither you nor we will have any right, power, or authority to create any obligation or responsibility on behalf of the other, and the Agreement is not intended to benefit, nor will it be deemed to give rise to any rights in, any third party. 

ELECTRONIC SIGNATURES:

By clicking on the “I Accept” or similar button, you create an electronic signature to the Agreement, thus creating a contract and accept these terms and conditions and any other agreement contained or referenced herein.
